Terms of Use

Please read these terms carefully before using TradeCopyFX services.

TradeCopyFX is operated and managed by ProTradeInvestments.

By using TradeCopyFX, you agree to the platform's Terms of Use, billing policies, and acceptable usage guidelines.

1. Introduction

TradeCopyFX ("TradeCopyFX", "we", "our", or "us") provides a software-as-a-service platform that delivers copy trading infrastructure, account management tools, and risk monitoring utilities for users of MetaTrader 4 (MT4) and MetaTrader 5 (MT5) accounts.

These Terms of Use (the "Terms") govern your access to and use of the TradeCopyFX website, dashboard, APIs, and related services (collectively, the "Services"). By using the Services you agree to be bound by these Terms.

2. Acceptance of Terms

By creating an account, signing in to the dashboard, or otherwise accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, you must not use the Services.

3. Eligibility

You must be of legal age in your jurisdiction and have the legal capacity to enter into a binding agreement in order to use the Services.

You are solely responsible for ensuring that your use of the Services complies with the laws and regulations applicable in the State of Kuwait and in any other jurisdiction in which you reside or operate.

4. Services Provided

TradeCopyFX is a technology platform. The Services include, without limitation:

• Trade copier tools that route orders between MT4/MT5 accounts.

• Account manager tools for organising and configuring multiple trading accounts.

• Capital protection tools for tracking balance, equity, and drawdown thresholds.

• Analytics, reporting, and automation utilities.

• A web-based dashboard for monitoring, alerting, and configuration.

We may add, modify, or discontinue features at our discretion in order to improve or maintain the platform.

5. User Responsibilities

You are responsible for:

• Maintaining the security and confidentiality of your TradeCopyFX account credentials and any broker or platform credentials you connect to the Services.

• Ensuring that your use of the Services complies with all applicable laws and with the rules of any broker or trading venue you use.

• Monitoring your accounts, copied trades, exposure, and risk at all times. Automated tools do not remove the need for human oversight.

• All activity that occurs under your account, including activity initiated by automated rules you configure.

6. Risk Disclaimer

Trading foreign exchange, contracts for difference (CFDs), and other leveraged instruments carries a high level of risk and may not be suitable for every investor. You may lose some or all of your invested capital.

TradeCopyFX is a technology and infrastructure provider. TradeCopyFX is not a broker, dealer, exchange, custodian, or financial adviser, and does not hold client funds.

TradeCopyFX does not provide investment, financial, tax, or legal advice. Nothing on the platform constitutes a recommendation to buy, sell, or hold any instrument.

You are solely responsible for your trading decisions, the strategies you copy, the configuration of your copiers and risk rules, and any resulting profits or losses.

7. Signal Provider Marketplace

The Signal Provider Marketplace is an area of the Services where eligible users ("Signal Providers") may publish a public profile so that other users ("Followers") can view their trading activity and optionally subscribe to follow their signals through TradeCopyFX's copier infrastructure.

Application and approval. Becoming a Signal Provider requires submitting a profile for review. TradeCopyFX reviews each application and any subsequent profile changes and may approve, reject, request modifications to, or defer any application or update at its discretion. Approval is not guaranteed, and prior approval does not create any right to remain listed.

Signal Provider responsibilities. If you are approved as a Signal Provider you must, at a minimum:

• Provide accurate, current, and non-misleading profile information, including display name, biography, trading strategy, and any other public content.

• Only connect trading accounts that you personally own or over which you have full legal authority to grant access.

• Not make any guarantees, promises, or representations of specific returns, profits, or performance, and not present past performance as an indicator of future results.

• Not publish misleading, fraudulent, manipulated, or deceptive analytics, screenshots, or claims.

• Comply with these Terms, all applicable laws and regulations, and any additional Signal Provider guidelines communicated by TradeCopyFX.

TradeCopyFX rights over the Marketplace. TradeCopyFX reserves the right, at any time and at its sole discretion, to approve, reject, suspend, unpublish, restrict, or permanently remove any Signal Provider profile, listing, or content, and to revoke Signal Provider status, in order to protect the platform, its users, or the integrity of the Marketplace, or for any other reasonable reason. This may be done with or without prior notice.

No endorsement or guarantee. Signal Providers are independent users of the Services. They are not employees, agents, partners, or representatives of TradeCopyFX. TradeCopyFX does not endorse, recommend, verify, or guarantee any Signal Provider, their trading strategy, their historical or future performance, or any information published on their profile. Any decision to subscribe to, copy, or follow a Signal Provider is made solely by the Follower, at the Follower's own risk.

Follower responsibilities. Subscribing to a Signal Provider does not eliminate the risks of trading. Followers remain solely responsible for their own trading accounts, exposure, risk configuration, and any resulting profits or losses. Signal Provider subscription fees are subject to the billing and refund policies set out in these Terms.

8. Platform Availability

We aim to keep the Services available on a continuous basis, but the Services are provided on an "as available" basis.

The Services may be temporarily unavailable due to scheduled maintenance, infrastructure upgrades, third-party outages, or events beyond our reasonable control. We do not guarantee uninterrupted or error-free operation.

9. Intellectual Property

All intellectual property rights in the TradeCopyFX brand, name, logo, software, source code, dashboard interface, designs, documentation, and underlying systems are owned by or licensed to TradeCopyFX.

You are granted a limited, non-exclusive, non-transferable right to use the Services for their intended purpose during the term of your subscription. No other rights are granted by implication or otherwise.

10. Prohibited Activities

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Services.

• Abuse, overload, or interfere with the Services, including through excessive automated requests.

• Conduct or attempt any unauthorised automation, scraping, intrusion, denial-of-service attack, or security probe against the Services.

• Use the Services for any unlawful, fraudulent, deceptive, or abusive purpose, or to facilitate any such activity by another party.

• Misrepresent your identity, impersonate another person, or use the Services on behalf of a third party without proper authorisation.

11. Subscription & Billing

The Services are offered on a subscription basis. Fees, billing cycles, and account-based pricing are presented in the dashboard at the time of purchase.

Subscriptions do not renew automatically. To continue using the Services beyond the end of your current billing period, you must manually renew your subscription from the dashboard before the current period ends.

If a subscription is not renewed before the end of the current period, access to the paid features will be suspended once the period expires, and any connected trading accounts, copiers, or protection tools tied to that subscription may be disabled in accordance with the platform's subscription lifecycle.

12. Refund Policy

All subscription fees paid to TradeCopyFX, including fees for platform subscriptions and Signal Provider subscriptions, are non-refundable, except where a refund is expressly required by applicable law.

Cancelling a subscription, unsubscribing from a Signal Provider, or ceasing to use the Services does not entitle you to a refund of any fees already paid for the current or any prior billing period.

You will retain access to the paid features until the end of the billing period that has already been paid for, after which access will stop unless the subscription is manually renewed.

13. Suspension, Restriction & Termination

We may, at our sole and reasonable discretion, suspend, restrict, unpublish, disable, or permanently terminate any user account or Signal Provider profile, in whole or in part, with or without prior notice, where we consider it necessary or appropriate, including but not limited to:

• Actual or suspected violation of these Terms, our policies, or applicable law.

• Fraud, abuse, deceptive conduct, manipulation, or misrepresentation.

• Security concerns, unauthorised access, or activity that threatens the stability or integrity of the platform or other users.

• Chargebacks, payment disputes, or non-payment.

• Compliance with legal, regulatory, or law enforcement requirements.

• Protection of the platform, its users, its Signal Provider Marketplace, or its reputation.

• Any other reasonable operational, technical, or business reason.

Suspension or termination may result in the loss of access to your account, connected trading accounts, copiers, capital protection tools, Signal Provider profile, followers, and any related data or configurations. Fees already paid remain subject to the refund policy above.

You may stop using the Services and cancel your subscription at any time from the dashboard.

14. Limitation of Liability

To the maximum extent permitted by applicable law, TradeCopyFX, its officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the Services, including without limitation:

• Trading losses, missed profits, or opportunity costs.

• Trades that fail to copy, are delayed, partially filled, or executed at unexpected prices.

• Outages, latency, or errors of brokers, liquidity providers, trading servers, or third-party platforms.

• Delays, interruptions, or failures in copying, signal delivery, or notifications.

• Any loss arising from a decision to subscribe to, copy, or follow any Signal Provider.

• Loss of data, profits, goodwill, or business resulting from third-party platform failures.

Our total aggregate liability arising out of or relating to the Services shall not exceed the fees you paid to TradeCopyFX in the three (3) months preceding the event giving rise to the claim.

15. Privacy

Our collection and use of personal information in connection with the Services is described in our Privacy Policy, which is incorporated into these Terms by reference.

16. Changes to Terms

We may update these Terms from time to time to reflect changes in the Services, our business, or applicable law. The updated Terms will be posted on this page with a revised "Last updated" date.

Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the State of Kuwait.

The courts of the State of Kuwait shall have exclusive jurisdiction to settle any such dispute or claim.
